Delhi has LGBTQ+ advocacy and support networks, but public acceptance and personal safety vary. Private consensual adult same-sex conduct is lawful; dating-app extortion and unwanted disclosure require practical precautions.
At a glance
- Private adult conduct
- The Supreme Court decriminalised consensual same-sex conduct between adults in Navtej Singh Johar in 2018. [Supreme Court of India: Navtej Singh Johar judgment, 2018]
- Marriage
- Same-sex marriage is not legally recognised; the 2023 Supriyo judgment did not establish a right to marry under existing marriage legislation. [Supreme Court of India: Supriyo judgment, 2023]
- Obscenity
- BNS Section 294 replaces IPC Section 292's obscene-material provision; Section 296 separately covers certain obscene public acts and songs. [Bharatiya Nyaya Sanhita Section 294: statutory text]
- App-related crime
- Delhi police reported arrests in dating-app extortion cases in 2023. Criminal luring is documented; this should not be confused with a verified claim of police entrapment. [NDTV: Delhi dating-app extortion arrests, 2023]
- Local support
- The Humsafar Trust publishes a Delhi office contact for community-service enquiries. [The Humsafar Trust: Delhi office and service enquiries]
Culture & nuances
Delhi has public queer advocacy and community spaces, but experiences vary substantially across the city and surrounding NCR. A welcoming event does not establish that nearby streets, accommodation or transport will be equally comfortable.
Family pressure concerning marriage, gender expression or reputation can make disclosure consequential. Respect each person's boundaries and avoid sharing their identity, location or attendance with relatives or employers.
Reported Delhi cases involve criminals using dating apps to lure and extort victims. Verify new contacts cautiously, refuse sudden moves to isolated locations and treat threats to expose private information as a safety issue rather than a personal failing.
Privacy & safety tips
- Limit profile details that identify your workplace, home, relatives or daily route.
- Turn off precise location and avoid reusing photographs from public professional accounts.
- Meet first in a staffed public location and refuse last-minute changes to isolated addresses.
- Use your own transport and send a trusted person a check-in time.
- Never hand an unlocked phone or identity documents to a new contact.
- Preserve threatening messages securely and seek trusted community or legal advice if blackmailed.
